Trusts and Estates
Our estate planning practice is marked by a sensitivity to the personal significance and importance that estate planning holds for an individual or family. We work as a team with insurance and accounting professionals to design a comprehensive estate plan for our clients ranging from young families to high net worth individuals. Special care and attention is given to seniors with elder law issues as well as families with special needs.
We are experienced in the preparation of estate and gift tax returns and in representing our clients in the examination of those returns. Our experience in the tax field encompasses estate and gift tax planning as well as corporate and individual tax planning.
Surrogate’s Court Practice
We provide the compassionate personal support to our clients and their families during the difficult time after death. Our firm is marked by more than 20 years of experience in the probate, settlement and administration of estates.
We handle all aspects of estate and gift tax issues, post mortem estate planning and the various challenges faced by families in crisis. In addition to probate, our Surrogate’s Court practice includes intestate administration, accounting, ancillary and guardianship proceedings within all boroughs of New York City, Westchester, Nassau and Suffolk counties.
Estate Planning For Special Needs
Our firm also concentrates considerable time to estate planning for families with special needs and the many challenges they face in planning for the future.
We meet those challenges through the use of Supplemental Needs Trusts, Guardianships and traditional estate planning techniques that are modified for those special needs.

As a natural component of our estate planning practice, the real estate and corporate needs of our clients include all phases of commercial and residential real estate acquisition, sale, leasing, financing and construction.

About Audra E. Dehan
AUDRA E. DEHAN is a sole practitioner in Melville, New York, concentrating her practice in the areas of estate and tax planning, asset protection, long-term care planning, estate planning for families with special needs, will and trust preparation, probate and estate administration, real estate, and elder law. Ms. Dehan works closely with accountants and other attorneys in the course of assisting her clients, and is admitted to practice law in both New York and Florida. Ms. Dehan is an attorney who creates lasting relationships with her clients, with a gift for understanding their needs from a personal perspective. This is especially true when creating special needs trusts, counseling families throughout the grief of losing a loved one, and long-term care planning. She handles matters with sensitivity, as quickly and efficiently as possible, to minimize both the emotional and financial burden legal matters can place on a family or individual. Her clients span the economic continuum from those of modest means with elder law needs, to those with more significant net worth and sophisticated tax needs.
Within her Surrogate’s Court practice, Ms. Dehan deals with probate, guardianship proceedings, estate administration, accounting and ancillary proceedings. She handles legal guardianship proceedings of parents applying to become legal guardians of their special needs children after they become eighteen, and has also been appointed as a guardian ad litem (a person appointed by the court to take legal action on behalf of a minor or an adult not able to handle his/her own affairs) in Suffolk County Surrogate’s Court in several estate proceedings. Preparing for a special-needs family member when the original caretakers are no longer able to do so requires expert planning. As an offshoot of her expertise in this specialized area of the law, Ms. Dehan is a frequent lecturer for local SEPTA (Special Education Parent-Teacher Association) groups, as well as professional organizations, including the AHA (Asperger Syndrome and High Functioning Autism Association) Conference at Adelphi University in Garden City, New York, and the Suffolk County Chapter of the Society of Financial Services Professionals.
Ms. Dehan was a member of the fundraising committee of the CODY Center for Autism and Developmental Disabilities at Stony Brook University, established to promote excellence in clinical treatment, research, community service, and educational programs benefitting those with Autism Spectrum Disorders (ASD) and related developmental disabilities. Since her involvement beginning in 2004, Ms. Dehan has donated many pro bono hours, speaking to parents and providing support workshops on legal matters that affect children with special needs. Ms. Dehan received her undergraduate degree from New York Institute of Technology and her Juris Doctor degree from Touro College Jacob D. Fuchsberg Law Center. She is a member of the Trusts and Estates Section of the Bar Associations of New York State and Suffolk County.

Joan S. Arbiter
Joan S. Arbiter is a sole practitioner in Melville, New York. She earned her law degree from St. John’s University School of Law and has been in practice for over 30 years. Since 2000 she has devoted her practice to concentrate in legal matters affecting the elderly and disabled.
She has an extensive background in real estate matters having represented buyers, sellers, lenders, and title companies as in house counsel. Lee A. Schwartz
Lee A. Schwartz, Esq. has practiced law for over 20 years in the areas of corporate and real estate law, and all aspects of trusts and estates. Mr. Schwartz advises companies on their day-to-day activities, as well as negotiating and structuring corporate acquisitions and sales.
He also provides general corporate counsel services that include the drafting and review of all types of agreements and other documents that arise on a daily basis in the corporate world. Lee graduated from the Ross School of Business Administration of the University of Michigan (Ann Arbor) in 1989 before attending Brooklyn Law School.
